Terms of Service

These Terms of Service (“Terms”) govern your use of Inkite (“Service”), operated by Inkite (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Inkite does

Inkite is an AI-powered brand name generation tool. You provide a company description, preferences, and optional constraints. We return AI-generated brand name suggestions along with positioning and scoring signals.

The Service is a creative tool, not a legal, trademark, or business advisory service.

2. Ownership of generated names

You own the brand names you select and use from Inkite. We do not claim any intellectual property rights over the output generated for you.

However, because our system generates names algorithmically, the same or similar names may be independently generated for other users. We do not guarantee exclusivity of any generated name.

3. No trademark or domain guarantee

Inkite does not perform trademark searches, domain availability checks, or legal clearance of any kind. Generated names are creative suggestions only.

Before adopting any name for commercial use, you are solely responsible for:

  • Conducting a comprehensive trademark search in your jurisdiction(s).
  • Verifying domain name and social handle availability.
  • Consulting qualified legal counsel as needed.

We are not liable for any losses arising from your use of a generated name, including trademark infringement claims, domain disputes, or rebranding costs.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or to generate content that promotes illegal activity.
  • Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
  • Resell, redistribute, or white-label the Service or its outputs without our written consent.
  • Interfere with or disrupt the Service's infrastructure or other users' access.
  • Use automated tools or bots to access the Service beyond normal usage patterns.

We reserve the right to suspend or terminate access for anyone who violates these Terms.

5. Account and access

Inkite currently does not require user accounts. If we introduce accounts in the future, additional terms may apply. We may introduce usage limits, paid tiers, or access controls at any time.

6. Service availability

We aim to keep Inkite available and reliable, but we do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

7. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that generated names are original, available for use, free of third-party rights, or suitable for any particular purpose.

8. Limitation of liability

To the maximum extent permitted by applicable law, Inkite and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty US dollars (US$50), whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Inkite and its team from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your use of any generated name.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Effective date” at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
